This Privacy Policy (the “Policy”) applies to your use of the website located at
https://www.orignmed.com (the “Site”), operated by RSMED Florida, LLC (“RSMED,” “we,” “our,” or
“us”), including any mobile sites, domains, sub-domains, or webpages through which this Policy is made
available. Because your privacy is important to us, we want you to understand how we collect, use, store,
and disclose your personal information. Please note that our telehealth services are currently only
available to individuals who are physically located in Florida, though our Site and affiliate programs may
be accessed nationwide by individuals 18 years of age or older. Capitalized terms used and not defined in
this Policy have the terms assigned to them in our Terms and Conditions, as the context requires.
Protected Information.
When you create an account with RSMED, you create a direct customer relationship with RSMED that
enables you to access or use the various functions of the Site and Service as a User. As part of that
relationship, you provide information to RSMED, including but not limited to your name, email address,
shipping address, phone number, and certain transactional information, which we do not consider to be
“protected health information” or “medical information.” This Policy applies primarily to general
information collected through the Site and your direct customer relationship with RSMED as a user of the
Site and Service.
However, in using certain components of the Service, you may provide health or medical information that
may be protected under applicable laws. RSMED is not a “covered entity” under the Health Insurance
Portability and Accountability Act of 1996 and its related regulations and amendments, as amended from
time to time (collectively, “HIPAA”). One or more of the Providers, Pharmacies, or Labs may or may not
be a “covered entity” or “business associate” under HIPAA, and RSMED may in some cases be a
“business associate” of a Provider or a Pharmacy. It is important to note that HIPAA does not
necessarily apply to an entity or person simply because there is health information involved, and
HIPAA may not apply to your transactions or communications with RSMED, the Providers, the
Labs, or the Pharmacies.
To the extent RSMED is deemed a “business associate,” and solely to the extent of its role as a business
associate, RSMED may be subject to certain provisions of HIPAA with respect to “protected health
information” (as defined under HIPAA) that you provide RSMED or the Providers (“PHI”). Separately,
any medical or health information that you provide that is subject to state-specific protections under
applicable laws (together with PHI, collectively, “Protected Information”) will be used and disclosed
only in accordance with such applicable laws. However, any information that does not constitute
Protected Information under applicable laws may be used or disclosed in any manner permitted under this
Policy. Protected Information does not include information that has been de-identified in accordance with
applicable laws.
The Providers have adopted a Notice of Privacy Practices that describes their use and disclosure of your
Protected Information. By accessing or using any part of the Service, you acknowledge that you have
received the Notice of Privacy Practices from your Provider.
By accessing or using any part of the Service, you understand that any information that you submit to
RSMED that is not intended and used solely for the provision of diagnosis and treatment by Providers,
laboratory services by the Labs, or prescription fulfillment by the Pharmacies, is not considered Protected
Information and will be subject only to this Policy and applicable state laws that govern the privacy and
security of such information. For the avoidance of doubt, information you provide to us in order to
register and set up an account on the Site, including name, date of birth, username, email address,
shipping address, and phone number, are not considered Protected Information.
